Brazil Hazard Pay Calculator (2026)
Data verified on
Brazil runs two separate risk premiums with two different calculation bases, and mixing them up is the most frequent payroll error foreign HR teams make. This calculator handles both: the unhealthy-work premium (insalubridade), normally a percentage of the national minimum wage, and the hazardous-work premium (periculosidade), always 30% of the employee’s base salary.
Two premiums, two calculation bases
Insalubridade compensates prolonged exposure to agents that damage health over time — noise, heat, chemical or biological agents, mineral dust. It is graded by a technical report under regulation NR-15 at 10% (low), 20% (medium) or 40% (maximum). Under CLT article 192 the base is the national minimum wage, which is R$1,621.00 in 2026, so the amount is the same for a junior and a senior employee doing the same job.
Periculosidade compensates the risk of a sudden, severe accident — flammables, explosives, electricity, ionizing radiation, armed security work, motorcycle couriers. It is a flat 30% under CLT article 193, and the base is the employee’s base salary. Article 193 §1 explicitly excludes bonuses, awards and profit sharing from that base, so the premium is calculated on contractual salary only.
Both entitlements require a technical report signed by an occupational physician or safety engineer. Properly used PPE that neutralizes the agent removes the insalubridade entitlement; it does not remove periculosidade, because protective equipment mitigates consequences but not the underlying hazard.
| Criterion | Insalubridade | Periculosidade |
|---|---|---|
| Rate | 10%, 20% or 40% | 30% |
| Calculation base | Minimum wage (R$1,621.00) | Employee base salary |
| 2026 amount | R$162.10 / R$324.20 / R$648.40 | 30% of base salary |
| Legal basis | CLT art. 192 + NR-15 | CLT art. 193 + NR-16 |
| Canceled by adequate PPE | Yes | No |
Why the minimum wage is still the base
This surprises most foreign employers. In 2008 Brazil’s Supreme Court issued Binding Precedent 4, which bars using the minimum wage as an index for salary benefits — while also holding that courts cannot substitute a new base on their own. The labor court (TST) tried to switch the base to the employee’s salary through Precedent 228, and the Supreme Court suspended that change.
The deadlock has lasted more than fifteen years. Until new legislation arrives, payroll practice continues to apply the minimum wage. The one reliable exception is collective bargaining: when a category’s agreement sets the base salary or the category floor as the reference, that clause prevails because it is more favorable to the employee. The calculator lets you switch the base for exactly that situation.
The two premiums cannot be stacked
CLT article 193 §2 prohibits paying both premiums at the same time. When a report identifies both risks, the employee chooses the more advantageous one — the choice belongs to the employee, not the employer.
The break-even point is easy to model. Maximum insalubridade is 40% of R$1,621.00 = R$648.40, fixed regardless of salary. Periculosidade is 30% of base salary. The two are equal at a base salary of R$2,161.33. Below that figure the maximum unhealthy-work premium pays more; above it, hazard pay wins and the gap keeps widening. For the 10% and 20% degrees, periculosidade is more advantageous at practically any salary above the minimum wage.
| Base salary | Insalubridade 40% | Periculosidade 30% | Better option |
|---|---|---|---|
| R$1,621.00 | R$648.40 | R$486.30 | Insalubridade |
| R$2,161.33 | R$648.40 | R$648.40 | Break-even |
| R$3,000.00 | R$648.40 | R$900.00 | Periculosidade |
| R$5,000.00 | R$648.40 | R$1,500.00 | Periculosidade |
Budgeting the real annual cost
Both premiums have salary nature, so they feed the 13th salary, vacation pay plus the constitutional one-third, and the 8% monthly FGTS severance deposits. Budget accordingly: the annual cost is not twelve monthly premiums.
The precise multiplier is 2.4. The 13th salary adds one premium; the constitutional one-third adds 0.3333 (the vacation month itself replaces a regular month, so only the extra third is new money); FGTS adds 8% of 13.3333 salaries, or 1.0667. Adding the twelve monthly payments, one year of a premium costs 14.4 times its monthly value.
For a medium-degree insalubridade of R$324.20 per month, that means R$4,668.48 over a full year rather than the R$3,890.40 a naive twelve-month calculation would suggest — a 20% understatement if the reflexes are ignored.
Frequently asked questions
How much is the 40% unhealthy-work premium in 2026?
R$648.40 per month — 40% of the R$1,621.00 national minimum wage. Because the base is the minimum wage rather than the employee’s salary, the amount is identical for every employee at that degree, unless a collective agreement sets a more favorable base.
Can an employee receive both premiums?
No. CLT article 193 §2 forbids stacking them. If both risks are certified, the employee picks whichever pays more. Isolated rulings have allowed accumulation based on international conventions, but the prevailing TST case law upholds the ban.
Does hazard pay apply to intermittent exposure?
Yes. TST Precedent 364 guarantees the full 30% even when contact with the hazardous agent is intermittent. It is excluded only when contact is accidental or so brief that it counts as merely occasional. The premium is never prorated by exposure time.
Is the premium included in severance calculations?
Yes. As a salary component it integrates the base for the 13th salary, vacation pay with the one-third bonus, FGTS deposits, notice pay and the FGTS termination penalty. Removing an employee from the hazardous condition ends the premium going forward, but does not undo the reflexes already accrued.
