How Brazilian overtime is calculated

The standard working week under article 7, item XIII of the 1988 Constitution is 8 hours per day and 44 hours per week. Payroll converts this into a monthly divisor of 220 hours (44 × 5 average weeks), which already includes paid weekly rest. Shorter contractual weeks use proportional divisors: 200 hours for a 40-hour week and 180 for a 36-hour week.

The hourly rate is the monthly gross salary divided by that divisor. Overtime is then paid at that rate plus a premium of at least 50%, guaranteed by article 7, item XVI of the Constitution. Article 59 of the CLT caps overtime at two hours per day and requires a written agreement.

For a R$3,000 salary on a 220-hour contract, the regular hour is R$13.64 and a 50% overtime hour is R$20.45. On a 180-hour contract, the same salary produces R$16.67 and R$25.00 — the divisor materially changes the cost of overtime.

When the premium doubles to 100%

Work on Sundays and public holidays that is not offset by a compensating day off in the same week must be paid double under TST Precedent 146 — that is, a 100% premium — without reducing the ordinary paid weekly rest. Collective bargaining agreements commonly extend the 100% rate to night overtime or to hours beyond a monthly threshold, and may raise the weekday minimum above 50%. The more favorable rule always prevails.

Note that most Brazilian employees are covered by a sector-wide collective agreement negotiated by their union, and those agreements are binding regardless of what the individual contract says. Before budgeting overtime for a Brazilian team, check the applicable convention: the premium, the monthly divisor and the treatment of Saturdays can all differ from the statutory baseline.

A separate 20% night-shift premium applies to hours worked between 10 p.m. and 5 a.m., with the night hour legally shortened to 52 minutes and 30 seconds. Night hours that are also overtime attract both premiums. This calculator covers the overtime premium only.

The DSR reflex: an easily missed cost

When overtime is habitual it becomes part of ordinary remuneration and increases the paid weekly rest (descanso semanal remunerado, or DSR). Article 7, §2 of Law 605/1949 sets the formula: total overtime divided by the number of working days in the month, multiplied by the number of Sundays and public holidays.

Because that calendar varies monthly, this calculator uses the market-standard simplification of dividing total overtime by 6, which is stable across months and slightly conservative. Habitual overtime also feeds the base for holiday pay with its one-third constitutional bonus, the 13th salary, the 8% FGTS deposit and notice pay — so the annual cost is considerably higher than any single month suggests.

Frequently asked questions

Why is the divisor 220 hours?

It comes from 44 hours per week multiplied by an average of 5 weeks per month, and it already embeds paid weekly rest. A 40-hour week uses 200 and a 36-hour week uses 180. Using the wrong divisor is the most common source of underpayment.

Is the 50% premium negotiable?

It is a constitutional floor, so it cannot be reduced. Collective bargaining agreements may set higher rates — 60%, 70% or 100% — and those prevail because they are more favorable to the employee.

What is the DSR reflex and is it mandatory?

It is a mandatory top-up on paid weekly rest triggered by habitual overtime, under Law 605/1949. The legal formula is total overtime divided by working days multiplied by Sundays and holidays; this calculator approximates it as total overtime divided by 6.

Can overtime be banked instead of paid?

Yes, through a time-bank arrangement: up to six months to compensate under a written individual agreement, or twelve months under a collective agreement. If the time off is not taken within the deadline, the hours must be paid as overtime with the applicable premium.
